End User License Agreement

1. Acceptance of Terms

By accessing or using the PlayFly platform ("Platform"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, you may not use the Platform.

2. User Roles and Age Requirements

Users: Anyone who plays games or interacts with content on the Platform must be at least 13 years old.

Creators: Anyone who creates, publishes, or distributes content on the Platform must be at least 18 years old or have legal parental/guardian consent.

3. Your Content

3.1 Ownership

You retain ownership of all content you create and upload to the Platform ("Your Content").

3.2 License to PlayFly

By uploading Your Content, you grant PlayFly a worldwide, non-exclusive, royalty-free, perpetual license to:

• Host, display, and distribute Your Content on the Platform
• Use Your Content for Platform operations, improvements, and features
• Create derivative works, adaptations, or modifications of Your Content
• Use Your Content for marketing, promotion, and advertising of the Platform
• Archive, backup, and preserve Your Content

3.3 Content Standards

You agree not to upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains harmful, offensive, or inappropriate material
• Contains malware or malicious code
• Harasses, threatens, or harms other users

4. Platform Rights

4.1 Content Moderation

PlayFly reserves the right to review, modify, or remove Your Content that violates these terms or our community guidelines.

4.2 Platform Use

You may not:

• Use the Platform for illegal purposes
• Attempt to gain unauthorized access to the Platform
• Interfere with the Platform's operation
• Create multiple accounts to circumvent restrictions
• Reverse engineer or attempt to extract source code

5. Account Management

5.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5.2 Termination

• You may terminate your account at any time
• PlayFly may terminate or suspend your account for violations of this Agreement
• Upon termination, your right to use the Platform ceases immediately

6. Intellectual Property

The Platform and its original content are owned by PlayFly and protected by intellectual property laws. You acknowledge that you shall not acquire any ownership rights by using the Platform.

7. Disclaimers and Limitations

7.1 Service Availability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYFLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

8. Changes to This Agreement

We may modify this Agreement at any time. We will notify you of material changes by:

• Posting the revised Agreement on the Platform
• Sending notice to your registered email address
• Displaying a notice when you next access the Platform

Continued use of the Platform after changes constitutes acceptance of the new terms.

9. Governing Law

This Agreement is governed by the laws of California, United States without regard to conflict of law principles.
